Terms and Conditions of Tuang Coffee

Welcome to tuangcoffee.com ("Site", "Tuang Coffee"). By accessing, browsing, or making a transaction on this Site, you ("User", "Buyer") are deemed to have read, understood, and agreed to the following Terms and Conditions. If you do not agree with any of these terms, please refrain from using Tuang Coffee's Site.
1. Definitions 1.1. "Site" means the e-commerce platform tuangcoffee.com and all related subdomains, including Tuang Coffee's online store at shop.tuangcoffee.com. 1.2. "Product" means all goods sold through the Site, including but not limited to coffee beans, processed coffee, and related merchandise. 1.3. "Buyer" means any individual or entity that makes a purchase transaction through the Site.
2. Acceptance of Terms 2.1. These Terms constitute a legally binding agreement between the Buyer and Tuang Coffee in accordance with Law No. 11 of 2008 on Electronic Information and Transactions as amended by Law No. 19 of 2016 (ITE Law), and Government Regulation No. 80 of 2019 on Trade Through Electronic Systems (PMSE). 2.2. Tuang Coffee reserves the right to change these Terms and Conditions at any time. Changes will take effect as soon as they are published on this page.
3. Eligibility 3.1. This Service is intended for users who are at least 18 years old, or if under 18, may transact with the permission/supervision of a parent or guardian in accordance with applicable law.
4. Products, Pricing, and Availability 4.1. Tuang Coffee strives to display Product descriptions, photos, and prices accurately. However, the actual color, taste, and appearance of Products (especially coffee beans as an agricultural product) may vary slightly. 4.2. Tuang Coffee reserves the right to change prices at any time without prior notice, provided that price changes will not apply to orders that have already been confirmed. 4.3. Stock availability may change at any time. If an ordered Product turns out to be unavailable after payment has been received, Tuang Coffee will contact the Buyer to offer a product replacement or a full refund.
5. Ordering and Payment 5.1. An order is considered valid once the Buyer completes the checkout process and payment has been received and verified by Tuang Coffee's payment system (including but not limited to DOKU and/or Xendit). 5.2. Tuang Coffee reserves the right to cancel orders indicated to involve fraud, system error, or violation of these Terms, with a full refund if payment has been received. 5.3. Proof of payment and order confirmation will be sent via email.
6. Shipping 6.1. Product shipping is carried out through third-party logistics partners. Estimated delivery times are approximate and may change due to factors beyond Tuang Coffee's control (weather, logistics conditions, destination location, etc.). 6.2. The risk of loss or damage to Products during shipping is the responsibility of the relevant logistics provider, and Tuang Coffee will assist with the claims process in accordance with the policy of the logistics partner used. 6.3. The Buyer is responsible for ensuring that the address and recipient details entered are correct. Shipping errors resulting from the Buyer's negligence are not Tuang Coffee's responsibility.
7. Cancellation, Returns, and Refunds 7.1. Provisions regarding cancellation, returns, and refunds are set out separately in Tuang Coffee's Return and Refund Policy, which forms an integral part of these Terms and Conditions. 7.2. In accordance with Article 4 of Law No. 8 of 1999 on Consumer Protection, the Buyer has the right to receive Products that correspond to the value and condition promised, as well as the right to file a complaint if the Product received is not as described or defective.
8. Intellectual Property Rights 8.1. All content on the Site, including but not limited to logos, text, photos, and designs, is the property of Tuang Coffee or its licensors and is protected by applicable Copyright Law in Indonesia. 8.2. Copying, distributing, or using content from the Site for commercial purposes without Tuang Coffee's permission is prohibited.
9. Limitation of Liability 9.1. To the extent permitted by applicable law, Tuang Coffee shall not be liable for any indirect, incidental, or consequential losses arising from the use of the Site or Tuang Coffee's Products, unless such losses are caused by Tuang Coffee's negligence or fault. 9.2. These Terms are not intended to waive or reduce the Buyer's rights as guaranteed by the Consumer Protection Law and its implementing regulations.
10. Force Majeure 10.1. Tuang Coffee shall not be liable for any delay or failure to fulfill obligations caused by circumstances beyond Tuang Coffee's reasonable control, including but not limited to natural disasters, national electronic system disruptions, government policy, or other force majeure events.
11. Dispute Resolution and Governing Law 11.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia. 11.2. Any dispute arising shall first be settled amicably through deliberation. If no agreement is reached, the dispute may be submitted to the Consumer Dispute Settlement Body (BPSK) or the Jakarta Selatan District Court (Pengadilan Negeri Jakarta Selatan), in accordance with applicable regulations.
